Terms of Service

These Terms are an agreement between you and Adeel Hamid, sole trader, ABN 61 661 477 964, trading as Evolamate ("Evolamate", "we", "us"), of Sydney, New South Wales, Australia. Evolamate is not a company or a separate legal entity — it is the trading name of this sole trader.

Evolamate is an early-stage product. By using it, you agree to the terms below. If anything here doesn't work for your business, get in touch before signing up.

What the service does

Evolamate researches your business from your website and the details you give us, and generates draft marketing content — text and images — for the channels you enable. Every draft requires your approval before anything happens with it. Nothing is ever published automatically without your approval.

Once you approve a post and have connected or enabled the relevant channel:

No other platform is currently supported. If we publish something and the platform does not confirm the result, we will tell you the outcome is uncertain rather than guess — you may need to check the platform directly.

AI-generated content

Content is generated by AI and may contain inaccuracies. You are responsible for reviewing every draft before approving it — for factual accuracy, for compliance with any rules that apply to your industry, and for anything else that matters to your business. We do not warrant that generated content is accurate, compliant, or fit for any particular purpose. Approving a post is your decision to publish it.

Your account and your content

You're responsible for keeping your login credentials secure and for the accuracy of the business information you provide. The content generated for you is yours. You can delete your account and all of its data yourself at any time from Settings.

Subscription and billing

Evolamate is a monthly or annual subscription, billed in Australian dollars through Stripe, our payment provider. New accounts start with a free trial; the trial length is shown to you before you subscribe, and again in your Settings while the trial is running. You can cancel at any time from Settings, and your access continues until the end of the period you have already paid for. See our Refund & Cancellation Policy for what happens to a subscription you've already paid for, and your rights under the Australian Consumer Law regardless of anything in that policy.

If a payment fails we'll email you and give you the chance to update your payment method before access to content generation is affected.

If we increase the price of your plan, we'll give you at least 30 days' advance notice before it applies to your account. If you hold a prepaid annual subscription, your current paid term keeps its existing price — a price increase only applies from your next renewal, never retrospectively to a term you've already paid for.

Service availability

This product is in active development. Features, pricing, and availability may change, and the service may have downtime or bugs. Some capabilities are labelled Beta in the product — those are real and usable, but less complete than the rest, and we say so where you use them. We'll do our best to communicate material changes directly.

We depend on Facebook, Instagram and Google, and those platforms can change their rules, their access, or their availability without notice to us. If that stops us publishing to a platform, we will tell you.

Liability

To the maximum extent permitted by Australian law, Evolamate is not liable for indirect or consequential loss arising from your use of generated content or the service more broadly. Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, including the consumer guarantees for services.

Governing law

These Terms are governed by the law of New South Wales, Australia, and you and Evolamate both submit to the non-exclusive jurisdiction of its courts — subject always to any mandatory laws and non-excludable consumer rights that apply to you.

What these terms do not yet cover

We would rather tell you what is missing than imply it is settled. These terms do not yet set out a specific liability cap, an indemnity clause, or the conditions under which we may suspend or terminate an account. Those are with our legal reviewer, and this page will be updated when that work is complete. If any of them matters to your decision, please ask us before signing up.

GST

Evolamate is not registered for GST. No GST is added to these prices — the amount shown is the total you pay. If that changes, we will update this page and tell you before it affects what you pay.
